Not sure: in Scotland spouse (married, civil-partner or common-law) has a right to access regardless of who's name is on deeds/tenancy

Thanks to eveyone who as replied much appreciated.

In brief the tenancy in my sole name, and his is classed as single over 25 man and no dependents. Nonetheless, we got into a tiz woz with some claims which got very confusing.
He did stop in a hostel which scared him half to death, he seemd very concerned. However, I am in the process of giving him some back pay that we are owed (once it comes through) it should be enough for him to have a deposit etc, then it is up to him whether he choose to work (no doubt he wont, he has only done 6 weeks work in our 4 years marraige! and I was not disabled until over a year ago) or he claims housing benefit etc.
As far as I am concerned I cannot do more than that, he's as good as said he doen't want a flat? or the responsibility of one? as when he had one before he couldn't deal with the pressure of (bills etc) and walked out? I was a bit shocked by this, so I can only assume he blow the money and move from place to another? still it is not my problem any more, i'v tried to help, but whats the point, if a hostel/shelters no good, but doesn't want the responsibility of his own flat? I give up. Thanks guys X X

Is he a child / totally useless?

    What does he want then?

Note that the rules for housing benefit changed last year so that it is now only those aged 35 or over who qualify for the LHA rate for a 1 bedroom property in the private sector if they are single and without dependents or disabilities. Those under 35 now qualify for a shared property rate, the equivalent of a bedroom in a shared house. It used to be 25 - he may perhaps not be aware of the changes which means he will not get sufficient HB to secure a 1 bedroom property to himself if he's under 35.

Sounds like you are best shot of this infantile, workshy 'boy-man' who seems unable to function with the very basic responsibilities that come with a household, fatherhood and a relationship - he seems to have abandoned you despite your care needs.

In the meantime, check the local council website to see if he would qualify for their rent deposit guarantee scheme if they run one. That way, he won't have to wait until your benefits come through to pay him off.

    Exactly!

There is home works who told him they would do a budget plan and help to find and locate him some kind of accomodation, he said they were useless. I don't even know whether he has called them, I would assume so as at the moment it is his best option, should he not want to remain in a hostel.

So i'v washed my hands now, im not helping anymore, quite frankly I am bit flabberglasted! Some opportunities are there, but none that his happy with, once I suggested private renting and getting work, he appeared mortified and said he'll sign on,, well good luck if he thinks for the next twenty years of his life involves not working or living of off women, I think he may be in for a shock!!

Forgot to say,he did work on a couple of other occassions, but got fired from every job, none lasted more than 8 weeks at anyone time. I worked full time and earned very well and kept us benefit free, but I came down with M.S and Epilepsy and could no longer work. We went to benefits and got the claims a bit mixed up, but he still has no intention of working, in fact, he said "i'll go to college and get support that way and then JSA can't make me work"!!! Not at all what I was expecting. Iv lost my good long hard well deserved job, have a disabled child and ilness myself, and all he can think about is getting out of work!! shocking guys isn't it!
