DFS/Santander/Drydens Fairfax CCJ court pack

Hi guys :o Here for a bit of advice on some nasty post I recieved last weekend...

I had taken out credit with DFS through santander in october 2011 for some furniture for my new house... with the payments to start May 2012... unknown to me these payments have not been going out of my bank - I also have a store card with santander which i make monthly payments for so when I have checked my bank statements I stupidly thought these related to the furniture...

a court pack from northampton dropped through my door last week for the total for the furniture + extra costs close to 1500. I managed to bring the balance down to 1000 and luckily for me my parents have been quite understanding and have helped me out by paying off the rest.

The court claim is dated 19 February 2013.

When paying the balance off the account tonight to drydens fairfax they said they are sending out a pack which explains what i need to do now - something to do with a form i need to fill out and return to the court and they guarenteed that as its been paid although a CCJ has been issued this will be removed and will not show on my credit history AT ALL and have no effect on future credit.

I'm just checking are they right in saying this? Will it defintely not show? As last week they were offering me a payment plan saying there would be no CCJ issued but then I read online the only way to stop it is to pay off the balance... so basically I dont trust what they say and what happens now...

Sorry for sounding a bit dim, but generally i have a good credit history and only ever had the odd one missed payment before this so im clueless about this kind of thing... help :-/

    Regardless of whether they record a ccj or not you will still have adverse credit recorded against you. For it to have gone this far the account will have 'defaulted'. And whilst you have paid, this will be marked as 'settled' but will still show on your report for 6 years. Therefore regardless of what they have told you about the ccj this will have an affect on applying for future credit.

    So there isn't a court judgement issued yet as you have 14+5 days to respond to the claim.

    You need to go to moneyclaim online and, using the claim reference and the password on the claim, respond that you dispute the claim because the debt is paid in full. There's a box to tick with this option. You will need to register and login first but this is easy to do.

    Everything then goes through electronically, which seems more reliable than the post.

    You need to do this as soon as possible now.
  • thank you so much for that - i have completed the defense electronically. drydens are a bit useless they told me not to send any of the claim form back in the original pack... they dont seem to know what theyre on about :-(

    But there's a general principle that says 'never get your debt advice from a creditor'

    Well done for getting this sorted. Your Santander entry on your credit report should be amended to settled default and no ccj should appear.
