My daughter signed up for a renewal O2 contract with a phone in the local O2 shop for £26 per month on the 23rd of February. A week later they notified her that as from 28th of February the price is going up over 3%, she hasn't even made the first payment yet can they do this?

It looks like it is allowed as their pay monthly contract states4. Charges/Price increases –
You must pay the charges for the services you subscribe to and use every month by the date on your bill. We charge interest if you’re late in paying. You have to pay by Direct Debit. We may ask you to pay a deposit before we’ll let you use the services. We may increase or decrease our prices from time to time. We won’t put your monthly subscription charges up by more once in any 12 months. Some increases would give you the right to end your Agreement without penalty. Details are in paragraph 5 of the Agreement.
As that will be the only increase allowed for the next year and equates to about 80p a month, it doesn't seem too bad.
See if the contract states anything about cancelling early due to the increase.0

Yes but they knew of the pending price rise 5 days later, they should have quoted her these prices or at least mentioned the fact. That would have been the fair thing to do.0

I renewed my o2 contract in January and was clearly told that the price would be going up at the end of Feb."If you think it's expensive to hire a professional to do the job, wait until you hire an amateur." -- Red Adair0

Judging by my recent experience with Vodafone in stockport, I doubt the guys in the shop know much about the phones they sell, let alone the intentions of the business to put up prices.

As your daughter was renewing, presumably she too was advised 'months ago' about this increase...My daughter signed up for a renewal O2 contract with a phone in the local O2 shop for £26 per month on the 23rd of February.
