End of tenancy notice: one calendar month after notice?

Hi,

I just bought a house and I will be moving out of the property I'm renting soon. My tenancy started 16th June 2012 and it's got a 6 month break clause.

I handed in my written notice on 28th February 2013 with the intention to vacate the property on 27th March 2013 the latest. I believe I only need to pay for 12 days (16th-27th March) but the estate agent says I am liable of rent until 15th April 2013.

This is what the break clause looks like in my tenancy agreement:

The tenant shall be entitled to terminate this Tenancy by giving Notice to the Landlord as follows:
- The period of the Notice to be a minimum of one calendar month
- The Notice can be served at any time during the Tenancy Term but the Tenancy cannot be terminated until after the first seven months of the Term
- The Notice period will expire on the last day of a period of the Tenancy and must be served in writing
- Notice must be served in accordance with the attached Tenancy Terms and Conditions

And the part of the Tenancy Terms and Conditions:
Notice to end of tenancy - Given by the Tenant to the Landlord
- Any Notice to be served on the Landlord by the Tenant must be served in writing
- The Notice period must be for a minimum of one calendar month to end no earlier than the last day of the Term of the Tenancy
At least one month prior to the expiry of the Term specified in the Particulars the Tenant shall give Notice to the Landlord or the Landlord's Agent specifying whether or not the Tenant will be vacating at the end of the Tenancy or whether the Tenant seeks an extension or renewal of the Tenancy


I can't see anything there that stipulates I should be liable for the whole month.
Am I right or is the estate agent?
If I am right but the estate agent holds its possition, what's the best way for me to move forward?

    The last day of a period is the 15th.

    "The last day of a period" means the last day of a rental period. Your rental periods run from the 16th - 15th.

    Your notice needs to expire on the 15th of a month.

    As said above, you leave on 15th. Gives you more time to move!

  • Thanks a lot ! To be honest, I'd prefer to save 19 days of rent :) than the comfort of extra days to move. This forum is all about saving money, isn't it :p

    The agent is right. However, you and the landlord can come to any agreement you like as long as it's confirmed in writing.

    If they find another tenant and they sign up to move in before the 15th of April then you shouldn't have to pay for those days. Expect to have to argue your corner on that one, mind.
