Notice to take possesion-mistake-advice please

Hi,
I need some advice,for the past 13 years,we always paid our rent on the Friday,it leaves my account on that day and only reaches the housing associations bank on the Monday.
This notice is based on the grounds that we are a week overdue one week,but in actual fact the money left my account on the Friday and into the housing association bank.
Can I appeal this and get them to rescind this,as we are not overdue?

  • sure you should be able to, is it private renting? seems awfully strict for a council or HA. could you not set up a weekly DD to stop this happening again
  • Its a housing association we are renting & I do have a weekly DD.
  • Sorry re read, daughter interrupter me before moaning, love teens, this does seem harsh for a HA, I would get in touch with them about it, . When my hubby was of work after an accident we had all sorts of trouble, especially whilst council to sort out HB. Best thing is to call them, and if you know the money is there every week, as i said set up the DD.

    If your payment does not reach the HA on the day it is specified to then yes you are late, It doesn't matter when/how you send it. only what day the HA receive it.
    However if you have paid this way for a long time then hopefully a quick phone call should sort it. Most HA are reasonable and a quick look at your records of continiuous payment should sort it, unless of course there is a new system in place that would make you have to pay on time in future, in which case you may have to adjust your payment date.

    wow your HA is harsh.

    Our rent is due by 1st of month, but as OH always got paid somewhere between 15 & 22 it was paid when we got paid, so was up 3wks late every mth. ( we should've paid a mth in adv when changed from wkly pay to monthly but due to debts couldn't manage it)

    The only time we ever got a letter was if we didn't pay one mth then a 2nd begining of mth and then we owed two. Our HA letters are sent once the a/c reaches a certain amount of arrears. We've had several notice of intents, as for various reasons the rent hasn't been paid by the time the second mth is due. These letters are sent automatically from our HA.

    BUT our HA has never chased these letters, as we call and speak to the rent officer and if not in a postition to clear the arrears we agree a repayment plan. Our situation is also complicated by the fact we receive part HB which is paid 4 wks in arrears. The notice remains in force for a while ( cant recall how long exactly) so basically if we dont keep to the agreement then they will enforce it.

    Do call your HA and see if this can be resolved?
