Car insurance claim help

Hey just wondering if I can get some help in who would be at fault for the below after a friend of mine was in a minor altercation.Not sure if its 50/50 or 100% for one of the drivers involded.

The below is her words of what happened and her car is an 2011 shape clio, can't remember his but an old p plate

I looked behind before reversing out of my car parking space and there was no one behind so i started to reverse very slowly. all of a sudden there was a car behind me, i had only gone about 1-2 feet out of the car parking space. (normally when I have reversed out of a space the car behind would either stop and let you out, or in this case, I think he has thought as I was going so slow that he thought he could swerve around me to get out before me) The man shouted saying it was my fault and how come I didn't see him. I said when I looked behind there was no one there. He didn't stay put, but drove further away and then got out of his car and came over with a note pad and pen taking down my REG and saying the insurance can take care of it all and could he have my name and telephone number. I looked at my car and there is barely a scratch and the rear left lights are all fully in tact. I went into my handbag and got my phone and took some photos of my car and his car. He was quite shocked when I started to take photos of both cars and then didn't hang around long but gave me his details before he drove off. I have taken the attached photos of my car to show that there is no damage to my car and the only thing on it is some tyre marks that will rub off. It isn't until i've taken the photo's that i've realised that he may be trying to make a claim against me for something that I haven't done, and that is why he didn't stay put but drove further out of the way to make me think that I had put the dint in his car. There is no way that I could have damaged his car as the tyre marks that were left on my car are on the rear bottom left corner and yet the dint in his car is well above the wheel arch on his front driver side. If I had gone into him and made the dint, I would have thought that that the whole of the wheel arch would have gone in. The shape of my car does not correspond with the damage to his car

  • Without seeing the pics it is difficult to comment on the damage, but it could be that the impact to the driver front side of his front bumper could push inwards and cause a kink in the upper part of the wheel arch on the driver front wing.

    I assume your friend was parked at an angle or was reversing out at an angle?

    Did she take a pic of the rear of her car in the resting position or had she driven it back into the space?

    Where her car made contact with his does put his car right behind hers at the point of impact, rather than if it was the driver side rear of her car that made contact, so this helps his case to argue he was behind her and there to be seen.

    Her problem though is she must inform her insurer of this, "for information purposes only" so they are aware, as her policy will require her to. Even if he never tries to claim against her, her premiums will most likely rise now.

    When reversing you need to keep looking behind you not just look before then go for it and hope nothing appeared or hope the cars behind stop.

    Too many people in a rush to go nowhere and unwilling to wait 3 seconds.
