Parking ticket from CMS Ltd for parking in a disabled space.

Look, it's all very well for you as a regular contributor advising people, and, as a result of being on here a lot and seeing lots of cases and injustices, advising a belligerent stance, but at the heart of this are a couple who have been ticketed and want this resolved.
My wording gives them a very reasonable position to put to the PPC which doesn't ramp things up and gives them a chance to do the right thing without further ado. Not everyone wants to carry on a war with the PPCs - some just want things sorted out.
OK, they are in a rotten business, and it does them no harm to know that members of the public know the law and if as a result they do actually educate their operatives in disability legislation (ok, may be a fat chance). then it may prevent some other disabled person who isn't "parking savvy" getting ticketed and paying up in future.0 -
Yes but I say the complaint needs to go to Robin Park, primarily, who will not want the hot potato of a disability discrimination case in their hands.
Copying in the PPC is secondary. Taking it to POPLA would be amusing as well, we haven't seen an Equality Act 2010 breach case considered by Shona at POPLA yet.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, but you do still advise them to go through the various appeals - Popla, albeit it in a nice way. That merely drags it out for the poor victims, and as we know, the scammers just crank up the pressure on the nice guys.
In this case, I would not expect the PPC to do anything except allow the appeal from the letter. That's the point of putting it short and sweet and they should know they are on sticky ground.
Now if they were foolish enough not to, would they go to court on it? I suspect not as they would be hammered when it was shown that the BPA guidelines had been ignored and the Equalities Act had been ignored.
By asking for the POPLA reference, it would cost them money to go there and a loss for them at POPLA followed by a stiff complaint to the BPA should, and I repeat should, not would, get them some penalty points on their record from the BPA who expect their members to follow the BPA rules. And they wouldn't need to go to pepipoo for advice with this. I expect c-m would be itching to put a case together for them !
Agree entirely that the retailer should be roped in as well, particularly on the point of training the wardens to recognise disabled tax discs and that the blue badge scheme is immaterial in a private car park.0 -

Whilst i agree with the sentiment of your comment.
PPCs have shown stupid is in their DNA.
BPA? pointless excercise.0 -

Funnily enough, the BPA do take it personally if one of their members doesn't follow the BPA guidelines. They have struck off members for a period from getting DVLA details in the past and another few points against the PPC might go towards the next ban, just like points on your licence.
But I bet the PPC will withdraw after the appeal letter.0 -

No the dvla struck the companies off not the bpa, their (bpa) points system is a complete joke and have only gone after the smaller firms as ppc_guy would confirm if he was here. The larger companies could commit criminal offences (apcoa) and face no sanctions at all.
The six who lost access for misconduct weren't even sanctioned, smart parking or whatever they calling themselves this week have been suspended recently, where are the sanctions from their trade body ?
The point is the bpa is run by ppcs and they won't do anything that interrupts the money from the cash cow otherwise known as motorists, basically nepotism at work. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Hi again.
Can someone help me with finding the owners/landlords for Robin Park.
I've googled it and come up with a few possibilities. CompletelyRetail, Prupim and McMullenwilson.
They all look like agents though, rather than the actual owners/landlord, or is that what i'm looking for?
Im usually quite good at finding obscure info on the net, but I have to say this one is being a bit ellusive.
Thanks.0 -
Write to the companies on site, they have the lease, CMS Ltd are their agentsWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
