can i claim mobility for my son ? already get middle rate care

brief history, my 10 year old son has mild cerebral palsy and learning disability, he also wets the bed 2-3 times every night.
we have always got middle rate dla since he was 3, but never mobility.
i am always honest on the forms and the last time the form stated "its not how far the child walks, its the way in which he walks" i told the truth and wrote that although he can walk however many metres the form said he either toe walks, walks with a limp and that he still struggled when wearing his splint.
i told them he was more prone to trips/falls etc and that he is no good on ice/snow etc.
we still got refused for mobility, the reason being "he can walk".
anyhow, ince then he has got a little worse, he has had botox in his affected leg and is due to see a surgeon in march to discuss lengthening his calf muscle.
just wondering if anyone knowss what our chances of a succesful mobility claim are?

    youre going at this from the wrong angle.
    if he can walk with any kind of normality and without severe pain he will not qualify for high rate mobility.
    you say he has learning disabilities. how does that manifest?
    does he need more supervision than is appropriate for his age?
    lower rate mobility is awarded primari;y for supervision needs

    My heart goes out to you, I can see that your family is struggling following redundancy and you are both hardworking with a disabled child. I cannot advise just wish to say I wish you were not going through this difficult time.

  • if he has care needs day AND night why doesnt he get higher rate care?

    not sure why he doesnt get high rate, i always assumed it is because he is not as severe as others who need the high rate.
    he has always complained his foot and leg get tired when walking, however it is after he has walked for about 20 minutes,again i was honest on the form and stated this.
    re learning difficulties, he is not your normal 10 year old, he has road sense but not much concentration, he is rather immature for his age and he likes to be in our sights when out and about, for instance today we have been to the park and farm with him and our 2 daughters, all 3 were on their scooters (which he is pretty good at and probably another reason we wouldnt get awarded mobility) and he wont scoot very far in front of us, he gets anxious if he cant see us, whereas normal 10 year olds are more than happy to scoot off around corners etc.
