Accident compensation... Help

Firstly let me start by saying I hate the compensation culture we have these days. However, in December I was a passenger in a car that effectively drove into the back of a hgv on a motorway.

Obviously I was very shaken and sore with some brilliant bruises from the seatbelt. Unsurprisingly my friends car was also a write off

However here I am 2.5 months later still suffering with pain in my coccyx and occasional pain in my heat where my breastbone meets my rib cage

My friends insurers have been ringing me every 2 weeks or so to see how I am getting on and I have been honest saying that although I feel better than I was I am nowhere near how I was pre-accident. I have had 9 sessions of physio to date, I have seen a doctor on their behalf and have been told I need at least 7 more physio sessions

I know the money will not make anything better, I will still be in pain, but I feel that the offer they have made is too low

I was unable to sleep initially, it was uncomfortable to roll, I was using cushions to sit on at home, work, everywhere. I also couldn't go out with my friends over Christmas and missed out on fully enjoying a black tie do for my uncles birthday.

What do you feel a fair settlement would be? I am not prepared to settle while I am still in pain....

Any advice would be appreciated

    Don't get advice like this off a forum.

    You need your own specialist solicitor acting for you.

    Google for cash back injury solicitors to find firms who pay you for giving them your instructions (£100s) on top of all the compensation they win you.

  • do not settle until you have recovered from your injuries or are confident that your symptoms will resolve fully within the time predicted in the medical report. But you absolutely need to take independent legal advice.

    I agree with Quentin. You want to be talking to a solicitor rather than people on a money saving forum. I know there are some forums where solicitors are quite active if you don't want to contact a firm yourself.

    Overall I think you should look more into this and ensure that you get the compensation amount that is right for your injuries.

  • Thank you. I will look into it. As I've been dealing with them direct I was cautious about approaching a solicitor. But they have offered a pitiful amount when I am still in pain (significantly lower than a months wages and I am not a 40% tax payer.

    I am not going to settle until i am in the same physical health as I was before. I just want to feel better!
