Amazon seller

Bit of advice from those in the know please. Just bought a pair of walking shoes from Amazon third party market place seller, opened box and found one of the lace tags has ripped off. Seller states on the returns form that payments for all returns are the buyers responsibility, as I've already paid postage for delivery of faulty goods should I also be expected to pay for the return. In the past, when goods have been bought direct from Amazon and turn out to be faulty, Amazon have always provided a prepaid returns label is this not the case with their third party sellers.

    No you don't have to pay for return. As the item is faulty, under the Sale of Goods Act you are entitled to either a full refund (including outward postage) or a replacement . The Seller has to meet the costs for returning the defective item if they want to have it back.

    The same thing happened to me recently, so I raised a claim through Amazon's A-Z guarantee and Amazon refunded me in full without me having to return the defective item at all. I suggest doing the same if the seller won't co-operate (although I would contact the seller first to give them the chance to do the right thing)

    Be clear you are returning under SOGA because damaged/ second hand/ poor quality or whatever and not the Distance Selling Regs.

    Thanks for the replies, Amazon have credited my account including the postage, don't think I'll be buying the same shoes again as they appear to be unsuitable for the purpose (walking) that they were designed for.
