Excel Lose In Court Again.

This time it was in a magistrates court with Excel acting for Bawtry Town Council (a sort of parish council) over a parking matter. The council has contracted out the parking to Excel who took a motorist to court. Our friend Rachel (toothbrush) Coates was Excel's legal eagle, by all accounts she messed the whole thing up and the case was dismissed.

The whole set-up over this seems rather unusual. Normally it's district councils who run car-parks, not lower level parish or town councils. It appears that Bawtry Town Council has just one paid employee, a part-time "parish clerk", so this is why they have farmed out car-parking "management" to Excel.
A lot of the discussion on PePiPoo seems to be about whether Excel can take motorists to court in their own right (instead of the council), and whether they are using the correct legislation to pursue these prosecutions. IIRC Town and Parish Council do not have any powers to form TROs and they are not part of the District Council set up, they are completely seperate entities. This is why they employed Excel.0

One question I have asked on PePiPoo is how do Excel make money from any of these court cases.I thought that any fines levied go into the public purse and not to Excel, but according to the the town council Excel get the money from any fines. I find that very strange, and it appears that Excel seem to have the same status as a council.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
