Accident Dilemma

Hi All

My 2 daughters were involved in a minor accident, thankfully no long term damage. They were both passengers and the driver was not at fault.
3 cars were involved, car behind went into back of car, that car then went into back of car my daughters were travelling in. Police were called and also ambulance and all 3 in my daughters car got took to hospital but none of the other drivers were injured.

Turns out the driver of car my kids were in is not insured, driver didn't know (young girl whose dad was paying but had an argument so he cancelled insurance without telling her!) so she didn't know until this accident.

She is claiming for whiplash through no win no fee as it was the fault of driver who hit her but the question is, is this the way to go for my daughters as the car they were in were not at fault so unsure how to claim off the fault driver.

Sorry if a bit confusing but could do with some advice on this?

Hospital Nd police reports are available but not sure way forward

    She can claim off either the driver of her car through the MIB who pay uninsured drivers claims out or through the driver who hit her insurance.

    Their legal company will no doubt chose the easiest route which would generally be through the other drivers insurance
  • Claim off the car at the back that caused it all. If your daughters felt one impact only and the car in the middle says they only felt one impact, the car at the back defo gets the good news.

    MIB are a nuisance and experts in making sub standard offers.

    Thanks for the advice. Did look at MIB and they are sorting it, so thanks dacouche. All 3 of the kids are claiming for whiplash and as they were the only ones to get taken to hospital and also damage to the boot of the car.

    Would normally be better to have claimed directly off the other Insurance.

    The MIB may send the bill (once they've paid it)for your injuries, your legal and their legal costs which for three whiplash claims could easily be over £15k to your friend.

    Do they actually have whiplash though, or are they trying it on for a little bit of cash?

    Wasn't sure how to claim as driver was uninsured, someone suggested a solicitor but as we have never claimed before, its a mine field to me so any advice is greatly appreciated.
    Kevie, my youngest is booked for physio and hospital were worried about internal injuries as had seat belt indentation but were reluctant to X-ray due to her age, so I would say yes she has whiplash, which is what hospital said for all 3 but I'm no doctor, so we are going on their advice.

    Could be very expensive for their friend. hope their whiplash justifies it

    How could it be a claim against the friend when it's not her fault? Surely it should be the driver who ran into the back of her or the car that ran into back of them, if that makes sense? She is going through a no win no fee company to claim for her whiplash and damage to car. Can anyone claim against a non fault driver, insured or not?
