Injunction Query

Can anyone help with this - How long does it take to successfully take out an injunction?

Took me 3 days in an urgent domestic violence case many years ago. Went to solicitor on day one, but it was a 5 pm appointment and couldnt get in court the next day, but did on the day after and the injunction was granted and in force.0

god... i could have sworn that said injection to start with :rolleyes: :rotfl:
right... well i dont know about the injunction thing but if you need some protection fast then i suggest you phone your local police station and have a word with someone,
my OH's ex was threatening and harrasing us by text, phonecalls, email and on message boards... there was always the threat she would turn up at our house and i just wasnt having it so i called the police and told them that i was worried the crazy cow would show up, nobody needs the whole "ex" drama thing anyway but i also had my DD to think of,
the lady on the phone took all the details, gave me a case number if i had to call back and she asked if i wanted a policeman sent round to the ex's house to tell her to stop it or else (which i didnt).... and the outcome of it was that if she turned up at my house she would have been arrested.
not exactly an injuction but its an instant fix and could do until you can get one.... plus the evil side of me actually wanted the fat mess to show up and get put away! sadly she didnt... ahhh well0 -

You can choose between an occupation order (to remove a family member from your house) and/or non-molestation order (stop a family member harassing or threatening you).
Go to local court ask at advice desk for form. You need to pay a fee of around £60 (cash or cheque only accepted, unless you are on benefits take your benefit books and child tax credit award notice).
Fill in form with all the info you have. Submit with payment to court and ask for hearing on ex-parte basis. i.e hearing based on your word only and as an emergency.
You will wait for the local Judge who will read your form and hear your case. Papers will then be served on other party. Then a formal hearing will take place after 1 week Approx) for both parties to attend to hear both sides story.
I would day no need for a solicitor to apply but that depends on how confident you are to fill in the paperwork. Also don’t apply for such an order just for the sake of it, there must have been some serious incident (or history) as sometimes judges don’t grant them forever depending on the strength of your case.0 -

In my case the injunction had a power of arrest attached to it, meaning if 'he' breached it he was supposed to be arrested. 32 breaches later, when they actually caught him 'in the act' he was arrested, followed by a SIX day committal hearing in which all the breaches were brought up. He was sentenced to 3 months in prison.0
