£600 Santander Fees

I have a current account with Santander (originally Alliance & Leicester). I stopped using it in Jan 2012 due to terrible service and switched to First Direct, I was £5.33 overdrawn.

Feb 2013 I get a letter from Santander stating my balance is now £605.83 overdrawn. The account has not been used for 13 months - this is entirely fees.

I called to complain to the collections department and was holding / talking for one hour. They offered to reduce the fees to £137.00, which I still refused to pay. They are claiming they didn't have my current address (which is untrue) and that was their reason for not sending me notice of these fees.

I feel that they have let me down as their customer, and I am thinking that taking them to the small claims court would be the best course of action.

Does anyone have any similar experience or advice on this subject?

  • It was an oversight, I thought it was all paid off when I stopped using the account, but a delayed payment for an item went though and I didn't check the balance again.

    isn't this just admitting liability that it was was your fault? if you say this in a small claims court i'm not sure how you expect to win.

    perhaps just pay the £137 and just forget about it?
  • I may be wrong but I thought that a Small Claims court was where you went when you were trying to claim money from an individual or a business. Since you are the person who owes money as a result of your own oversight I doubt that you will find this avenue open to you.
