    I feel this is correct.

    They have now admitted there is a problem with the product. Therefore the retailer has to arrange a remedy which doesn't cause significant inconvenience. For a mattress, that's going to rule out it being away for a period of time, so the purchaser can insist on a replacement or a refund.
  • I bought it from Amazon direct not a marketplace seller. The email was addressed to me with a link to click which gave me a pdf containing the letter I copied into the OP.
    I've spoken to trading standards who said the contract is with the retailer so I should pursue it with Amazon and they cannot ask me to pay the postage, TS said they would have been willing to pursue it on my behalf except Amazon is not a UK registered company and not covered by the same laws, they gave me the number of some European trading standards to ring grrr.
    Now I think if I ring Amazon they'll be happy to sort it except they don't do Hypnia mattresses any more so I'm sure they'll offer a refund, the trouble is I got it for a bargain price and I love it.

    identified a recent batch of hypnia memory foam mattresses which do not meet the acceptable level of fire retardancy required to pass the BS 5852 test.


    I'd be talking to Amazon and getting a replacement or refund, but that's up to you OP.

    Just a thought:
    If you do choose to do nothing and were unlucky enough to have a fire, I wonder if the insurance would pay out as you knew you had an untreated mattress?

    I totally agree with Sagz and have done exactly the same as I have purchased my mattress from Amazon a portal I trust so in my opinion Amazon is kind of responsible for their seller and should help me with my concern.

    I feel that it should the supplier that covers the cost for the return. I would be concerned about not getting the mattress treated though, I wonder how you would stand regarding insurance if you had been warned about a product and then failed to act.
  • I would call amazon if only to confirm that the email is genuine - otherwise I can see the call with the limited company including the phrase, 'and if you could just read out the 16 digit number from your card please?'.
    If this is genuine then the retailer has admitted the fault in the product and they need to offer redress including for your expenses in dealing with the matter.

    If you bought the mattress on credit card go to your credit card company and request a refund from them. All credit card companies offer protection on all purchases and you will get your money back within 14 days.

    As for the mattress after that I doubt the company whoever they actually are will come and collect it.
  • I have purchased this mattress from a Amazon market place seller and I did also received the letter. I then try to contact them what was clearly a waste of time as they try to talk me out of sending the mattress back. I contacted amazon to help me out and they opened an claim what shortly afterwards was closed with the note I do not have to try it again. I was thinking to add a review so that other buyer have at least the chance to see what happened to some other buyer but amazon did not publish the review and they did not told me any reason why. So if you go no on to their portal you see just very nice reviews...wondering how many reviews they got rid off.

    I let you guys think about that but I learned my lesson.
