selling a house/divorce

Hi, im not sure if this is in the right place, if not can an admin move it please?

Basically, my aunt and her husband are getting divorced, she desperately wants out as her husband has a new woman. She is still living in the house but he just uses it as a base to come and go. the home is mortgage free and shes desperate to get out and start afresh where as he is happy to keep coming and going. the house is on the market but over-priced and he wont come down on the valuation (shes willing to take a loss to get it gone) as its not costing him anything and he has the best of both worlds!

is there anything that can be done to force this through, its been over 12months they 'seperated' and have begun divorce proceedings....?

    She'd be best seeking "proper" legal advice from a solicitor.

    The courts will only intervene to force the house to be reduced if it is over valued for delaying tactics. If it is priced according to a survey then there is not a lot you can do, market conditions will dictate the sale and they are not good at the moment.

    If it is over valued you could ask a court to allow you to reduce it to the going amount, but it will be difficult for you to get them to allow you to sell it for less than it's worth.

    Ask him to pay her, her percentage (50%?) based on his valuation.

    i dont think he can afford to buy her out...though ill insist to her that she needs to go back to her solicitor!
