    Thanks David. I had a quick look around but there doesn't seem to be anyone local for me and those advertising have quite a high call out rate. DH has decided to buy a new one and keep the old one for now and see if he can find a fella to fix it for his beers :beer:

    Would my wife get redundancy if her boss sells the shop as a going concern but my wife doesn't work for the new owner ?

    The boss said she will stipulate that the new owner has to keep her on but what if my wife doesn't want to stay ?

    I can only speak from the experience I had some years ago. I worked for an accountant who had an Esso franchise. I had been working for him for nine years when out of the blue he introduced us to the new owner. As I wasn't keen on the potential new boss I said I would take redundancy, but, according to him as I was being offered the same terms as my original contract I wasn't entitled to redundancy pay. I believed him as he was an accountant. Apparently as my job was still there, technically I wasn't being made reduntant! It may be an idea to ask at the job centre where your wife stands though.

    No i did do paddy power though and it tracked god knows when or if it pays but we shall see :)

    Well i went to work today for 4 1/2 hours and my knee is sore again, but hey ho if thats all ive got to moan about , thats not bad.

    When the Company You Work For Has Been Taken Over

    In general, the Transfer of Undertakings Protection of Employment regulations (TUPE) ensures that when the company you work for is taken over by another, your contract of employment is automatically continued by the new proprietor. This means that if you worked a company for one year before it was taken over, and then worked for the new company for another year after that, you would be entitled to statutory redundancy pay because, from a legal perspective, you have completed two years of continuous work for the same employer.
    If the company you worked for was taken over, and the new proprietor agreed to continue your employment as before, but, for some reason, you decided not to accept this, you would not be entitled to redundancy pay. Your decision would be considered a form of voluntary resignation.
