disciplinery meeting

My son was called in to his office late friday to be told he was suspended until Monday where he will have a meeting with 2 managers and the claim he has commited gross misconduct
His alleged crime he works for a company how deals in loft insulation and wall cavity filing . he also deivers letters to council tenants as the government subsidy's so they can save on heating costs.
he is given specific post code areas to work .

He was on one of his days given a a small of block of 4 flats that had no warden and non of the tenants were in so he slid 4 letters under the security door .
This is what they are trying to sack him for !
he hasnt been given any written notice

    He has worked there 2.5 years
  • So what has he actually done wrong? Failed to deliver the leaflets properly because he only pushed them under the security door??

    Correct they are accusing him of gross misconduct although he has had no formal training as what to do in this situation and also no notice he was suspended for this on Friday and will be attending another meeting later today the HR girl told him the MD wants him sacked ! All for 4 letters under a door completely disproportionate
    and he hasnt been given a formal letter to attend !
  • It is possible that the meeting he has been called to attend may be an investigation meeting. AFAIK there is no requirement for you to be invited to an investigation meeting by letter, and you have no right to be accompanied.

    It is possible that the meeting he has been called to attend may be an investigation meeting. AFAIK there is no requirement for you to be invited to an investigation meeting by letter, and you have no right to be accompanied.

    He was told "he dumped letters in a stairwell "(stairs are the other side of the door it was only 4 and he admitted he couldnt get access to the properties and slipped them under the door , the company is trying to lay off people as they are in trouble.
    He presumes its a disciplinary meeting as the had a meeting on friday where they asked his version of events and then promptly suspended him

    When someone has opened the the door the letters have probably spread / blown into the hall / stairwell and look like they've been dumped.

    Not giving advice though as not my field

    Letters visible on the floor from outside also advertise "nobody home": whenever I get the Yellow Pages visibly left on the doorstep or the free paper only half way through the letterbox I phone and complain for that reason.

    I'd suggest that he is apologetic: "I am sorry I did this, I now realise I shouldn't have done but had not received any instructions for this situation." Although they might feel it's common sense ...

    Because it's littering. There's no difference really between pushing them under the security door and opening the security door and just dumping them inside, the effect on his employers and the residents is the same.

    The company wants the post to be delivered to the actual flats.
    The residents may complain about littering.
    The owner of the flats may complain about littering.

    But gross misconduct seems a little OTT for the first time. I would suggest he says he realises now it was the wrong thing to do and why, and that he won't do it again, and cross his fingers.

    Have I got this right the security doors have to be buzzed when someone needs to enter? Now when I was cold calling I was told to avoid them like the plague as never got much joy. I can see the point about litterng by leaving the leaflets there, but gross misconduct is a bit extreme.

    I would suggest appealing any decision made.
