...which would be voided, because you have a statutory exemption from displaying a disc.

The 5 days grace is written into law. It's not a guideline or concession which is subject to someone's agreement.

You simply CANNOT be convicted of the offence of failing to display a tax disc if you meet the relevant criteria.

Calm down, I didn't say you could.

Who says he's driving anything? He's on holiday, his car is on the road at home, with a soon to expire tax disc.

How do you know his car is in the road at home? He could be driving round France for all you or we know, until the OP comes back its just guess work but if he is leaving it at home he should get it off the road.

You got a link to this then? Cause it ain't no difference to having an operators licence.

Yes it is different. A (valid) operator's licence is also covered by the exceptions ("valid tax disk or similar" in my last post) but an expired, or yet to come into force, tax disk is just a piece of paper like an "I've been to Bognor" sticker.

I agree that the degree of obstruction caused is no different, but the rules differentiate between things that "need" to be there and things that don't in order to stop someone filling their screen with stickers.

In fact, with an out of date or (more likely) a yet-to-start tax disk you could also be prosecuted under reg. 7 of the Road vehicle (Registration and Licencing) Regulatioms for

" exhibiting anything resembling a vehicle, trade or nil licence"

because it's something that could be

"mistaken for a vehicle licence, a nil licence or a trade licence which is for the time being in force"
