  • Using the service can be taken that you have accepted the terms. OP should have followed it up and seen it through to the end previously.

    Yes I used the service - but i didn't specifically pay for it - I just continued to pay the same monthly amount I had been paying for years.

    They had history of upgrading my account without me having to make a commitment. After the initial 2 year contract ended I continued for a while on 3GB per month - they upgraded my allowance it to 5GB per month without a contract.

    I understand this and I am not trying to be obstructive. I am also not saying you are lying by saying they told you ot definitely wouldn't mean a new contract.

    The point I am trying to make is that you should have 'officially' disputed it sooner. If they said they were going to sort it, you should have made sure you had confirmation of this in writing. By not doing this you have weakened your position.

    If you are still paying the same as previously but are getting a much bigger data allowance then this would be a reason for them keeping you in agreement. I appreciate as I said though that they told you this would not be the case.

    Okay - so I think I understand my position - by not correctly pursuing the issue to the end (to be honest they just wore me down) and by using the service in the meantime, I am now committed to pay them off. What chances do I have if I pay off the bills and exit fee of getting my money back through complaints to ombudsman or through small claims court? Or would I be better off not paying?
  • You'd be better off paying if you don't need a good credit file - they've probably already given you a late marker though.

    This kind of thing can have a serious impact, if it hasn't already.

    £165.42 to close the account including the early exit fee. I have been robbed:mad:

    I will write a letter requesting the recordings of all conversations (under their obligations under the data protection act) I fear this wont get me anywhere. I will also attempt to get the records of my "email" attempts

    The record will show:

    1) I raised the issue as soon as I received the bill

    2) I only paid the same amount and via the same direct debit arrangement as before

    3) I bought the mifi dongle unsubsidised at the time because I didnt want to sign up to a contract

    4) I didn't knowingly use the service beyond the previous service

    5) They failed to get my agreement to a contract at any point

    I am not going to give up until I get my money back
