Refund of deposit

I saw a car on line on Peugeots used car web site , and the car was 150 miles from us , so I rung the dealership up spoke to a sales man and paid him £50 deposit to keep the car it was a 1.6 diesel . The same evening I spotted another car exactly the same but with a bigger engine 2.0 diesel , the next day I spoke to the dealership with the 2.0 car and they offered it to me for the same price as car from the first dealership, so I told them that I would have it and rung the first dealership asking for the deposit back .I have been and bought the 2.0 version , but I still haven't had the refund back off the first dealer yet .Am I in my right to get my £50 back off the first dealer under the DSL.

Yes you are entitled to the deposit back in full under DSR as it was paid online. I assume you never at any time went to see the car.

No Bris we never went to the dealership at all , we live in Pembrokeshire the first dealer was in Weston Super Mare the second one where we bought the 2.0 from was in Bromsgrove.
