    hi everyone

we have now received the letter from PCM saying that we have 2 options:#
-pay the fee within 14 days, or
-challenge the issue of the PCN (which we already did before and appeal was rejected).

It also says we can appeal to POPLA. Is this a standard thing they encourage people to appeal to POPLA?
Also it says that debt collectors may take legal action against us and take the case to the county court etc.... if it's successful, a county court judgment (CCJ) would be made against us and this may affect our credit rating.
The credit rating bit worries me the most, so shall I still ignore them??
You dont have credit with them do you?
And you would only get a CCJ "IF" they won the court case(not likely), and you refused to pay the judgment sum!
That aint going to happen so their is no need to worry!:)

I don't think they actively encourage it, as it costs them money. Did they provide you with a POPLA reference code? They should have done. If they didn't, that just shows how much they (don't) encourage you to use it.

If they don't provide a POPLA reference within 35 days of your original appeal, then their case is dead in the water, as they will have breached the BPA CoP. Don't remind them that they haven't issued one - it's up to them to give, not you to ask. After 35 days, you could inform them of their failure to provide a code, and thus you consider you appeal accepted and the matter closed.

Thank you surfboy1- that makes sense about CCJ.
The Slithy Tove- no there's no ref number for POPLA appeal. Don't remember when we exactly appealed but just checked the date for the rejection of our appeal to them and it's on the 1st of March so already more than 35 days!!!

There should be a verification code somewhere for POPLA, either on the covering letter or on the form. You need to appeal to POPLA and get this cancelled at their expense; of course it's standard to offer POPLA, they have to, as mentioned on every other thread here... There are sticky threads telling you about POPLA and POPLA decisions, at the top of the forum. Having posted in February we've assumed you'd read the forum a bit and would have been ready for this and been preparing your POPLA appeal already?

Here's one someone on pepipoo did recently, very similar circumstances and with a POPLA appeal recently submitted with some very strong points and demands for evidence which PCM will never be able to answer:

So check carefully for your POPLA code, it should be there somewhere. The missed deadline of the 35 days will be the tip of the iceberg of their failures that you can draw to POPLA's attention if you have a code. Do some digging like NitramA did and you'll be amazed at the formal and detailed appeal you can devise.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
