Hi,
I am trying to rectify what I think is a problem with my share of freehold transfer.
The solicitor has completed a TR1 form to transfer the whole of the register, thus I believe requiring all freeholders to sign in agreement to the sale/transfer.
Could it have been possible the previous solicitor filled in a TP1 form to transfer a part of the freehold when the other flat sold? Hence us not being asked to sign anything, and the new purchaser still being transferred onto the freehold??
Would we be able to complete a TP1 as opposed to the TR1 the purchaser's solicitor has sent me to complete the transfer? They have no issue with my sale, but want to make sure the document still lists everyone in their separate flats, which the current form does not state, so will need amending. (Difficulty is other 2 freeholders work away from town during the week, and return only at the weekends, and we are meant to exchange on 5th March!)
I'd be grateful for any advice....0 -
In the present circumstances all the registered proprietors of the freehold title would have to complete the Transfer anyway so whether it is a TR1 or TP1 would make little difference from a timing perspective.
You can have a split freehold but I am sure Richard Webster or propertyman and others would be able to advise on the issues around this for you.“Official Company Representative
