But from what he has written the case is not over yet and my opinion is that the DJ has gone wrong in law. Whether or not that forms the basis of the OP's case from here on is not down to me. It might be the case that the OP drops it and we hear no more about it. That won't clarify things from the point of view of the law, but at the end of the day it is what the OP wants to do that matters as it is his case, his situation, his circumstances and he must do what he feels best. Whatever he does, I wish him all the best.
I know people won't accept that a DJ could get something wrong, or that it is a matter of law; and the majority of posters feel that the OP has no case as he has to prove the goods were faulty from day one. Then there are those who feel he should simply accept that the period of time the shower lasted was sufficient to meet the requirements of s14 (2). Those are all points of view..... and people are entitled to to those and to air them.0
