How have you quantified that at 10%? How could OP justify that in front of a judge?

You know fine well zaax just picks a random figure from his mind with no consideration for what the law says :P

OP, they have a no quibble returns for a full refund on their website, however they do go on to add a part about if you're a business, check their commercial T&C's.

Did you order as a consumer or for business purposes?

Restocking fees are allowed in B2B contracts (after all, DSRs are the consumer protection regulations) but if its arrived in that manner, it is still covered by the SOGA - just certain parts dont apply and its possible to contract out of some rights/responsibilities.

No CD-ROMs, no chance to recover it in case of Operating System failure.

Most computers don't come with CDs although some let you order them as an extra, you make your own back up disk when you start up the laptop for the first time...

    As a consumer.

If you havent done so already, i'd write to them stating you are rejecting the item outright for a full refund as it does not conform to contract (as per SoGA). If you google "soga template letter" or something similar....you'll get loads of templates to give you an idea of what to write.

Remember to keep it simple and to the point. Include important details (such as date, price etc) but dont be tempted to tell them how you feel (angry/disappointed/upset......it doesnt matter, its a business transaction and including details like this just increases the chance of them not reading it properly). Dont be afraid to tell them what you want (a full refund).

If you've already tried arguing with them about it.....I'd entitle the letter "Letter Before Action" and include a sentence along the lines of if they fail to respond/refund within 14 days, you'll be starting court proceedings which may result in them incurring additional costs.
