Notice pay

Options
Hi I have recently taken voluntary redundancy and have to work 6 weeks notice. My employers have have this will be on a weekly wage. My notice period falls two weeks in February an whole of march. They have advised my pay will be less by approx 300.00 for march. I have queried why I have not been paid my normal monthly salary for both feb an march given I have worked the whole of both months an led to believe that my notice pay is weekly even though my contract confirms I'm on monthly salary. Can anyone advise. A solicitor as advised me i shoukd be entitled to my normal monthly salary but would like second opinion. Thank you

Tell them you will take it to tribunal. You have 3months after the end of your contract. Your notice pay should be full pay.

This doesn't make any sense. If you work the whole of february and the whole of march, you are entitled to be paid for those months in the normal way. The fact that during six weeks of those two months you were working your notice is irrelevant.

I suggest that you wait and see what amount you get in your final salary payment If it is less than it should be, you write to them pointing out the error and giving them 14 days to pay up, and then make a tribunal claim. For the moment it is still free to make an ET claim.

Also make sure you get all outstanding holiday pay due to you.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
