Consumer rights -money back guarantee

Hi,

I just wanted some advice on a product I recently purchased from an online healthcare retailer. The item comes with a 60 day money back guarantee as listed in the manufacturers warranty, however the retailer I bought the item from is not the direct manufacturer. Consequently where do I stand with the validity of the guarantee, is it invalid because I didn't purchase direct from the manufacturer? If it is valid and I wish to claim under this guarantee do I apply for the refund via the retailer I purchased the item from or the direct manufacturer?

Did the retailer advertise the offer at all or is it only mentioned by the manufacturer? If its the latter, just ask the manufacturer and retailer politely if they'll honour it.

Hi, its only advertised by the manufacturer, as listed in the instruction manual for the product. However if I am being honest I emailed the retailer prior to purchasing and they stated that they would not uphold the guarantee.

Then all you can do is contact the manufacturer and ask them. If the offer makes a statement such as "at participating retailers" or something to that effect, they'll likely say no. But theres no harm in asking.

Hi sorry to bring this up again, I have recently been trying to pursue a refund under this guarantee but both the manufacturer and the retailer I bought it from are declining to refund any money. The retailer states that they do not offer the guarantee but the manufacturer are claiming they will not authorise the guarantee because I didn't buy it directly from them!

Just to clarify the manufacturer states both on their website and in their product manual that 'All <Manufacturers name> products come with a 60 day money back guarantee.' Also on their website the T&C's for their guarantee state nowhere that only items bought directly from the manufacturer will be included!

Please can someone advise me if anyone is in the wrong and do I have a leg to stand on with regards to getting my money back?

Your legal rights are with the retailer. A manufacturer can only add to those rights not take them away.

The retailer has never promised you a 60 day guarantee, so, in my view, you've nobody to enforce it against.
