Redundancy and notice period advice please!

Advice please.
Workmate got his redundancy notice on 8/02/13 (12 weeks to end 03/05/13). He is 46yrs old and has been with company for 30 years. His top pay is £330.00 per week. Boss has worked his redundancy at £7590.00 and our holidays run from 1st January to 31december so it has been worked out at 9.5 days hol pay. He has been offered another job to start on 02/04/13 but if he leaves early will he still be entitled to same redundancy?

    You need to look up counter notice.

    this can be done within the statutory notice period and protect the redundancy

    is he 47 before 3/5/13

    the redundancy might be over I make it 22 weeks worth (1*20 +4*1/2) * £330

    12 weeks for someone with 12 years or more service.
  • Yes he has 12wks notice but if he leaves early 29/03/13 instead of 03/05/13 will he still get his full redundancy and he is not47 until July.

    Provided the employer agrees to him leaving when he wishes (the employer can also serve a counter notice) then he would be entitled to his full redundancy payment, but his entitlement to notice pay would end when he left.

    The best thing to do is simply to speak to the employer and ask if he can take his redundancy early and leave without working his full notice.

    Alternatively he will have to explain to his new employer that he has a 12 week notice period, he has asked to leave early but his employer has insisted that he works his full notice. Most prospective employers will accept this, as they'd expect you to do the same if you leave their employment.
