  • Have you contacted your service departments office to ask them for help. You may be entitled to The service equivilant of DLA for mental trauma caused by fighting for ones country. Cannot for life of me remember name. So that would help with your income. And it would not be counted as income for income related ESA.
    You can complete an ESA 1 over the phone as it is well over 12 weeks since the last claim ended. There is an 0800 number on the direct gove website. It seems that you are being given the runaround and this will be adding to the stress making your PTSD Worse? Also google PTSD as there is support out there for people with it. Ex servicemens clubs may also be able to help.
  • Occupational pensions are counted in full for IB ESA. Your information about the disregard is for CB ESA.

    There is no point in completing an ESA1 - your claim has not ended, it has changed to a credits only claim. You could claim DLA if you have care or mobility needs.

    Any pension income over £85 per week is taken into account at the rate of 50p in the £ over the £85. So if your pension income is £95 pounds per week this is £10 over the £85 allowed and so £5 is deducted from your CB ESA.

    The OP is no longer entitled to CB ESA.

  • This is where Its confusing already, you chaps know what you're on about and can't agree. The DWP allegedly know what they can't agree.

    My information is from the Decision Makers Guide - this is the authority used by the DWP.
    Treatment of occupational pensions in ESA(IR)
    51050 Payments of income from occupational pensions should be taken fully into account.
    Occupational pension schemes are set up by employers to provide pensions for
    employees and their dependants.

    I don't think Schrodie read your post correctly.
