I am after some advice for a friend who rents a house to my neighbour.
The scenario is as follows. The guy who is living there now used to share the house with his girlfriend and baby. There is no written tenancy agreement and the guy now owes over £1000 in rent.
My friend last weekend turned up on the door step and handed him his notice in writing giving him a month to move out, which i feel is fair.
Today the tenant has called him up and said he has been to Citzens Advice and that he has to give him two months notice is this correct.

Yes it is correct, the landlord must issue a S21 to the tenant giving him 2 full tenancy periods. Even then if the deposit has not been protected in one of the deposit protection schemes AND the prescribed information given to the tenant then that notice would be invalid.

Some of the things we will need to know........
Exact start date of tenancy and fixed term length
Was it joint and several or did they have separate agreements for individual rooms?
How much is the rent? (There may be another way to go if there is 2 months owing)
Just that much should get you some answers, but advise your friend to stay polite to the tenant, he can ask him to pay rent as often as he likes, that is not harassment, issuing invalid demands to leave could be seen as that, so softly softly until everybody has sorted out what you need to do.0
