What guarantee is there with Amazon?

I bought a replacement new battery for a laptop last June from Amazon, (fulfilled by Amazon), it cost £16+, it will not hold the charge now, so I contacted the seller through Amazon and was told nothing could be done as more than 3 months had elapsed.
I replied that I could not see anything on Amazon or the sellers information, and as it was sold as new it should be guaranteed for a year.
I got this reply this morning

Please allow us to explain that we follow the policy of Amazon, but it is not stated in the seller information. Amazon only takes return or replacement within 90 days since the purchase date.

We are really sorry for the problem. In fact, moreover this battery is already out of stock now. We aren't capable to send you a replacement. So we sincerely suggest you to buy another one from other sellers. You can check the same lisitng of the battery (ASIN: ******). There are still several sellers offering the product.


I have checked Amazon and the seller still have these batteries in stock!

Is it true about the 3 month rule?
Its not about the money, but I feel I am being ripped off.

    One, you didn't buy from Amazon.

    You Bought from a marketplace seller and Amazon fulfilled the order.

    There is a very distinct difference. You will need to refer to the terms of the seller (it does not matter what rules Amazon have, you didn't buy from them).

    Check the terms for the shop you bought from. Note this though, there is no 12 month guarantee unless stated on the item or the terms of the seller.

    Chargers and Batteries tend to be separately warrantied to a laptop when bought, for example, Dell only offer a 90 day warranty on new chargers and batteries, whilst the laptop itself will be covered for a minimum of 12 months.

    That is true, but doesn't override the general statutory rights under the Sales of Goods act. It is probably reasonable to expect that the battery should last at least 12 months, although as it's over 6 months old the onus is on you to prove it was faulty when sold.

    Playing devil's advocate, £17 seems quite cheap for a laptop battery, so it may be argued it wasn't expected to last longer than 9 months.

    It may be worth a phone call to Amazon to see what their position is. They generally like to keep customers happy, even ones buying through marketplace.
