Regarding No Refunds

Hello everyone

Last year i join the Bin Weevils game site for my young son he quickly become bored with the site and never really used it.

I did not realise that it was a recurring membership site and forgot all about it until today.After all it was a year ago!

£34.95 was taken via a paypal recurring payment.

I tried to contact them by phone only to find out the line was disconnected.Eventually i managed to get in touch by email.

I wanted a refund but they refused saying they have a no refund policy.I can understand if my son had used the service but he had not.:(

The renewal only started today so i do not see a problem below is the email i recieved.

What is the legality of no refund services on the internet?

Memberships purchased online using a Credit Card or PayPal will automatically recur at the end of every billing cycle unless cancelled. We have a renewing membership system because many customers prefer an uninterrupted service rather than having to re-enter their billing details every transaction.

Unfortunately, Bin Tycoon subscriptions not cancelled before the payment due date are non-refundable. This policy is agreed at the time of purchase and fully outlined on the page of our website.

Although we are unable to refund your payment, we can confirm the future renewal of your membership has been cancelled and no further payments will be taken from you.

If you have any further questions, please contact us again.

  • It depends on (a) if the product type is covered by the Distance Selling Regulations or not and (b) if the service is considered to have "commenced" and their T&Cs stipulate that commencement terminates your cancellation rights.

    Outside of the DSR, you also need to check that they have followed any of the actions they say they will take before renewing. For this class of business there is no legal requirement but if they say they will inform you before hand then they must.


    Assuming they have well written T&Cs then basically there is no right to a refund and you must follow their cancellation process NOW to avoid the same issue again next year

    Read the terms and conditions, this is the contract you agreed to when signing up. Many people don't use gym memberships, that is actually how the chains make their profit, but the members are not entitled to a refund because they contracted to a minimum term.

  • The problem with these type of Internet Membership sites is the they charge a annual recurring fee,but many people, like me did not fully read the terms and conditions or because its a yearly fee simply forget to cancel.

    I have now been told that if i had cancelled yesterday everything would have been fine,even contacting them within ten minutes of the rebill was not good enough.

    I just wish there was a law made to make sure companies emailed or contacted people at least 7 days in advance to remind them of any rebill.

    I am just glad i found out now by checking my debits and not like a friend of mine who cancelled his Sky subscription a few years ago but did not stop his debit with his bank.On checking his statement nearly eight months later £50 a month had still been debited from his account.

    He did not even have a Sky box !!!

    Without wishing to sound harsh, not reading the terms and conditions is your fault and not a "problem" with the site.

    And as for your suggestion regarding a law to remind people of rebilling - sorry you, like everyone else, have to take responsibility for what you sign up to.
