Was he driving dangerously or not?
Probally, he was driving to fast for the country road, came round corner on wrong side of road and could not stop when he seen our car. He told this to police him self. There where skid mareks where he tried to break before going into side of our car. As far as police where concerned it was his fault anyway.TOTAL 44 weeks lose. 6st 9.5lb :T0 -

we paid 5k for our car axactly a year ago so not sure how much we will get if it is written off, I understand about the access and loosing the NCD until the claim is sorted but as my insurance was only renewed 6 days ago hopefully theis will be sorted before my next renewal. My policy says I do not loose any NCD anyway unless 2 claims in 4 year period so fingers crossed.

Hi, sorry to hear of your dilemma and husband and son's accident, hope they are ok. I am just letting u know about timescales. Our car was stolen in January (while on holiday!!!) and we still haven't got it sorted yet. We are paying for a hire car £120 a week as the insurance only covers u for 2 weeks, so we are so out of pocket. We paid £13k for our car and its looking like we will only get £6k approx back as it was an MG and they went bust so we are truly gutted.
My NCB wasn't affected as i protect mine, however when getting new car ins quotes it always asks if you had not had protected NC, would u have lost it, so the answer is yes so not sure whta difference it makes.

you will usually receive the market value for the car being written off - this is not forecourt value as this includes mark up's for staff, commission and overheards, you will receive what the car is worth. Your insurer insures your car and not you - therefore personal injury is an uninsured loss and has to be claimed back via the third party's insurer. You can go direct them and make a claim or use your legal cover policy. There should be no question over liability if they told the police they were going too fast....if they change their mind your insurer can apply for the policy report which will state fault is not with you. Anyone in the car at the time can claim personal injury from the third party insurer as its their policy holder who caused the injury in the first place. Nowdays you can receice around £2000 for whiplash.
With regards to flutterby_ill you should make a complaint and ask your insurer to a) pay for your hire car costscontinue to pay for the hire car and C) pull their finger out. I used to deal with insurance complaints and if the insurer delayed they should pay. We used to refund hire car charges all the time and we used to take over the rental charges until the claim was settled as we received a discount. I would consider complainng to the Financial Ombudsman Service. If you've not complained to their insurer they will refer your complaint to them but they treat it more urgently if it comes from the FOS. Hope this helps.
Sorry about the car by the way.....cost of MG's have gone through the floor. You should demand a higher payment for the delay, you will be gob smacked at the amount of compensation i used to pay!0
