    And if he hasn't paid it in full, how about paying it now so that he can re-apply for the benefit?

    Late payment of NI can never qualify you for benefits if you do not have contributions in both tax years.
    I am unsure if it's possible to qualify if you have had significant earnings and NI conts in one year, and then pay NI conts late for the other year.

    I'm about to read the DMG to see if I can see anything on late payment of class 2 NI. to see if they say it's not allowed.

    says this "Class 2 contributions count towards certain benefits, like the basic State Pension, Maternity Allowance and Bereavement Benefit. But any claims for benefits may be affected if your payments are late."

    41038 says there are exceptions, but I don't have time to find them out.....ok I have a little time to waste so here is a bit more.

    03240 A decision not to award a contributory benefit, or to award it at a lesser rate, may be revised at any time if after that decision is made a late paid contribution or credit is treated as paid at the same time as or before the date on which the original decision not to award, or award at a lesser rate was made, and as a result of the late contribution or credit the original decision would have awarded benefit or would have awarded it at a higher rate1.

    Which is still not telling us how late payment might be considered to have been paid on time. I suspect this has more to do with HMRC "law" rather than ESA "law"

    Those bolded words are interesting, it may be implying that late payments of NI class 2 is fine as long as they are paid prior to date applying for benefit. But if paid after applying then they have to go through a checking proceedure to see if they can qualify.

    My hubby has had Crohns since 1997 and has never had to claim a penny before, it makes me mad that we cant even claim the cost of his meds. Think ive had my rant for today.

    I wasn't being sarcastic when I said that, I mean it. It is something we all have to go through :/

    As the others have said you can apply for free prescriptions on low income or get a pre paid certificate. We had to do this for my dd before free prescriptions came in here :) She was working and on a low wage, but had 7 different creams on a weekly basis, so worked out quite expensive to pay each prescription separately.

    It is still worthwhile filling in the ESA50, if he's found unfit for work, he will still get his contributions towards his pension contributed
