Freezer breaks down, food spoillage.

My sister bought her Candy fridge freezer New from Argos 3 months ago. Last week it broke down which resulted in a lot of spoilt food. She has now had it repaired but it took a week before someone actually came out and changed the gas compressor. There has been a load more problems as Candy were not very helpful and my sister had to call them several times.
Anyway it's fixed now but when my sister asked about being reimbursed for the cost of the food they aren't too keen but she's gonna try anyway.
Can I ask your advice about this please, any information would be great.

Maybe the manufacturer's warranty covers it.
    Check the documentation.

That's was my understanding also. Wouldn't bother pursuing Candy, they wouldn't be interested.

(FWIW, I didn't even know Candy were still making electrical appliances, haven't seen them at all since they stopped sponsoring Liverpool years ago).

That will mean making a claim which will cost more in the subsequent years of insurance. It's an option of course, but not the most sensible one.

Keeping it simple, the three month old freezer failed and this failure broke the contract under Sale of Goods/Supply of Goods & Services Acts to provide goods of satisfactory quality, fit for purpose, as described, etc.

Therefore, the costs incurred as a result of the breach of contract must be met by the party from whom the item was purchased. In this case it appears to be Argos. If they aren't helpful, the small claims court will have to be used.

Don't be tempted to add extra food onto the list you claim, these types of claims are frequently checked.
  • Thanks everyone for your help. Argos have been a little more helpful but she has to log everything down so your help Is invaluable.
    Youre all stars. :A
