Court date, worried!!!!!

Hi,

I've been trying to claim £3200+ from lloyds tsb for my parents, i previously done two one for myself with NATWEST and got £800+ and then my g/f who got £1100+ (HSBC).

My Parents are with lloyds tsb and these have proved more difficult (is this normal?) I issue claimed on moneyclaim online and they enetered and defence and has now been passed to my local court, I stupidly sent the originals to lloyds with my template letter and don't have a copy, in there defence they are saying I have just selected a general amount of money and not itemised it which I did do, I highlighted every charge. I'm worried I'm gonna get a court date soon and have to send these statements again, what happens if I have to, will I need to get them again from lloyds tsb and do I need a solicitor, I've done if for my parents as I say and they are worried they might have to stand up in court and they don't understand it totally, thats why they asked me.

I'm at my wits end i don't know what to do, don't want to let my parents down or cause them trouble can someone please tell me everything is going to be ok and some advice on what I should do.

    You need to get back the statements you have sent to the bank and produce a list/spreadsheet of each charge with a description and the date taken. This should have been done rather than highlighting and sending the statements as this list is part of your defence should it come to court along with the statements to back it up.

    It is quite common to receive a letter from the bank or their solicitor asking for this information as you can read in this thread...

    This, however doesn't mean the case will end up actually going to court but it may happen.

    Firstly, don't panic! Your parents are not on trial, they are the victims! The banks aren't actually on trial either, but s*d them! Lloyds TSB do appear to be the current hardball champions, although they don't close accounts in a fit of pique like Nationwide!

    However, you do need to get that information back.

    Don't forget that the banks have an "Achilles heel": the last thing they want to do is to have to say, under oath and in an open court, just how much (or how little) it does cost them. They will do anything, hopefully even cough up, to avoid this.
    The acquisition of wealth is no longer the driving force in my life. :)

    I find tsb to be harder than most,im awaiting a final letter from them.Went into the bank yesterday as they said im going to get charges for being overdrawn,£30 plus interest,i said i didnt think i was overdrawn,they said yes by 10p !!! anyway they let me off this time... £30 for 10p where is the justice in that..keep on fighting as the other person said they are the guilty ones,and i dont think they have actually taken anyone to court as yet,probably will be me who will the first..

    Thanks for your replies :D they make me feel a little better, but just one more question, if I need to get those statments back, do I have to send the first templete letter again with another £10.00 to get them, and if I do, will the bank not think to themselves that they can get the case threw out of court as I can't supply the statements in time for the court case. I haven't got the court date yet but I know it has been transferred to my local court so should get a date any time soon, and the bank can hold out for 40 days to give me the bank statements. I feel like i'm well in over my head :eek:

    They did sort of tell me they were putting £750.00 into the account as full and final settlement of the account, without asking me to accept or decline, which I thought was a bit sneaky, but was told to just second a letter advsiing that I would not be accepting such a payment as full and final settlement and that I was now taking them to court for the full amount. I think that is ok.
