Tricked into employment?

    I don't think your OH was 'tricked' into employment but it seems common practice for care agencies to promise hours then not deliver and they certainly don't give the full picture at interview, otherwise nobody would ever work for them! More like lying by ommission!

    I work very part time as an enabler/support worker with what seems higher than usual hourly rate for care workers (about £1.35 over NMW). There's still a lot of rushing around between service users but we get paid travel time at our usual hourly rate plus petrol allowance.

    But, as is usual in the home care industry, aside from travel time between clients, I only get paid for the time I actually spend with the client. I was also quite firm with when I would work i.e. mornings only, otherwise I know from experience they would have me on the go from 7 a.m. until 10 p.m.

    Have to agree very strongly with other posters, your OH MUST report what she has witnessed to CQC!!

  • Bit of an update really and some more advice required pleaseeee?

    CQC have taken full details, however not sure what they will do.

    Okay well as expected they will not pay her for the hours worked, they say that she should only be paid for hours worked (not fair but okay we saw that coming)

    But the main issue is they say they will deduct training fees from her wages, she signed a training fees form and agreed to repay this, but as above they didn't keep their agreement so why should she?

    In addition they don't have a signed authority to make deductions from wages, so if they do what can we do?

    Clearly there is no point taking this to employment tribunal, because there just isn't the case.

    How on earth do we get the money she is owed? I'm not sure?

    I would say " fine, keep the money and when I raise my complaints about your service with the council who gave you the contract, and maybe the local media I will add the keeping of my wages to the list". Even if you never complain to anyone they won't know if you have or haven't and if your wife isn't going to get her wages then she won't have lost anything by making them wonder. Companies like these make me sick, those are peoples lives they are messing up and folk deseve better xx
