accident due to council not maintaining the road?

  • My mistake - it needs reporting to the insurance company but since the injury was only to the driver, no need to inform the police.

    The OP has damaged the property of a third party (the hedge) and it is surely then a reportable incident?

    Failure to report (ASAP and within 24 hours) is an offence.

    I have successfully claimed from a council for damage caused by a large pothole (or rather - my motor legal / uninsured loss recovery people did), so it is possible, but how much they fight it depends on the council, I suppose.

    Get as much evidence as you can - photos with a ruler on etc. to help
