one in the eye for UKPC

There is a thread on the consumer action group about a chap taking ukpc to court as they kept putting their pcn's on his car whilst parked in his private space.

The summary is he gets expenses paid at a hefty £1,280 and damages at £150!

Love it!

    What a good result, I do hope ukpc break the undertaking to the court, oh that would interesting
    For everthing else there's mastercard.

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • I really support this guy and give him massive credit for having the balls to do this.

    For me, I am in a similar situation as I live on a privately-managed estate. We own the freehold to our parking space outside our house. Before Christmas we received two invoices for parking in our freehold space.

    My wife is the RK of the car but is more than happy to ignore everything that UKPC has sent so far. In our situation we had discussed taking it to POPLA but some of the early decisions made us decide to ignore, ignore, ignore.

    Having a newborn in the house means we have to pick the battles we fight and whilst annoying to receive the junk mail from UKPC, putting them in a drawer is the best option for us right now.

    If you think you have a case, send a letter before action seeking money from damages from trespassing onto your land, they will probably pay up to avoid another day in court :rotfl:

    Do a well worded lba and you never know what you might get

    Only the land owner / freehold owner can sue for actual losses.

    If I was you, I would write to the Parasites, explaining that you have come to angreement with the land owner / free hold owner and that you have settled with them, so you will be paying them nothing. If they have a problem then take it up with freeholder, who is you...

    Given the total is more than £600 it would be great if they didn't pay - I can hear the sheriffs getting prepared already ....... ;)
