TSB charged me £30 today for going OD, can I reclaim???

Hi all :j

TSB (bless them) have today charged me £30 for going over my agreed overdraft by £6, and for one day!!!

My question is, am I able to claim this back or what would you advise me to do as right now £30 is a hell of a lot of money.

    Yes, definitely claim it back.

    As it is a relatively small amount (in the grand scheme of things) I would call them and ask for it back.

    I know its not a lot of money, trust me I feel like a real moaner coming on here to complain about one charge of £30 :o

    Partner has rung the main call centre to complain and even said he was going to close the account but he said they basically couldnt care less and said they we not going to drop the fee. Do you think we should call into our own branch? If so what should I say and I dont want to get tongue tied once I'm there!

    Even though it's a low amount, technically you can still make a court claim.

    It's up to you how far you want to take it, and ultimately how much you want to p*ss the bank off.

    Personally I'd write a letter to your local branch and put the arguments forward the same as you would at court, i.e. unlawful, unfair etc, and see if that has an effect.

    If not then it's up to you to decide how much hell you want to create for £30.

    Also depends how oftne you've gone overdrawn in the past? If it's only the frst or second time, butter them up and apologise and try and get it back. Usually works....y

    The call centre staff can only tow the party line and then try to sell you something. The branch (or store, as some banks evidently now call them) may have a little more flexibility, but don't forget the possible legal ramifications of them coughing up. That said, try the softly, softly approach by all means. If it works, great. If they play hardball, then you know what you have to do in return.

    Never forget that these "extravagantly excessive" charges are illegal. Even though they are in the T&C's, a contract must be legal, and unlawful T&C's are unenforcable. No bank is going to want to have to advise how much (or how little) it does cost them to automatically administer a breach of contract (which itself could be unlawful) in court. This is their "Achilles heel".
    The acquisition of wealth is no longer the driving force in my life. :)

    This is the first time that we have ever gone overdrawn with our bank, which is why I think its pee'd me off so much.

    Definitely going to take your advice and write to our local branch and show my disgust at their charges. :mad:

    Tbh if its the first time I think you will easily get it back by just going into your local branch - act reasonably, say you can't understand why £30 for the sake of £6 etc etc, it was unforseen, won't happen again, etc etc. If you write you may just get fobbed off with the "party line" . IMO much better to do face to face.

    Feeling nervous already!!! But I'm not going to back down, £30 is a ridiculous amount to charge.

    I would go into your branch , to the enquiries counter, and firstly in a friendly manner etc talk to person on the counter . If they say sorry, can't help, just stand your ground and then ask to see managr. make sure you go at a time you can afford to wait around for a while cos they could keep you hanging on to spk to somebody with authority. I honestly think you will get a result just by doing this. Then , you do still have option that you could go away then call for an appt - just say you want to discuss your accounts - be vague!! \The reason I wouldn't do this first is that you are most likely going to be givn somebody trying t9o sell you things with an appt like that - and you are building it up to be a bigger deal than necessary too. By just "popping in" , I would imagine you will get it sorted in abt 10 mins, really hope so anyway! Good Luck!
