Loyalty rewards - part of contract of sale?

Hi,
This is my first post, so please be gentle!
I'm having a bit of a problem trying to claim loyalty reward miles from a well known airline. The airmiles were added to my account after a purchase of a hotel stay in March 2012, but after some recent difficulties with the same company, I checked back on my account to find they had disappeared.
I followed the instructions to reclaim the miles, sending copies of the invoice and email confirming the booking, which included a statement that xxx number of airmiles would be added to my account on the date of check in. The response was that as it was more than 'a generous 6 months' from the date of purchase, they were not able to do anything.
I'm pursuing this with the customer services team from the company in question, despite being ignored since the initial rebuff. My question is this - does anyone know if the loyalty miles offered at the time of sale (and confirmed within the sale confirmation / contract) forms part of the whole contract?
many thanks in advance for any help.
Lily
