Tax Fine

I sold a 50cc scooter back in December 06 - I sent the V5c off as normal and gave the new keeper the green slip. Last week I got a letter trough stating that I had been fined £40, rising to £80 if unpaid before the 15th,for not taxing it, or declaring it off the road. I even have the receipt for the Recorded delivery of when the v5 was sent.

I wrote a nice letter stating that it had been sold, gave the date etc and provided a copy of the receipt.

I today got a reply stating that I am responsible or the fine as I didn't receive an acknowledgment letter from them and that this is stated on the V5c (which I no longer had as it had been sent to them!)

I don't actually have £40 nevermind £80 as I have just lost my job -How the hell is this justified? They fail to process it and its my fault? :confused:

    As you sent it recorded delivery can't you track it as being delivered to DVLA then tell them to get stuffed !! If it was delivered to them then Watchdog and your MP are the next ports of call ..... being fined for the incompetence of DVLA ..... another wonderful Labour tax.

    I have, on the advise of someone on another forum, printed off the signature from the royal mail website and sent this with a covering letter, politely telling them to bog off :)

    We'll see how it goes.

    I'd keep refusing to pay the fine and let them take you to court for it , if you can prove you sold the bike and sent the slip off and it was received at DVLA then I would like to think a judge would find in your favour , if the worst was to happen and he / she found against you then at least you could plead poverty and pay £1 a week.

    I would agree ... I had a similar experience over a £60+3-point Speeding ticket my father got.

    When they took him to court for his alleged failure to supply, I contested it on his behalf and submitted the Recorded Delivery receipt into evidence (which the clerk of the court verified the delivery of actually in the court) ... My father was found not guilty, the Prosecutor was admonished by the bench, and I asked for (& received) an award of £1130.00 in costs against the prosecution.
