Pay rise after discharge - query

    Hi Alan

    If you have no IPA on you then your Bankruptcy lasts a year,in certain cases early discharge is possible and so you are discharged after roughly 6 months .

    But if you get an IPA then that takes the total time before discharge to 36 months


    Im sure i will b corrected if this is wrong:D

    Just spoke to the OH and he's going to speak to the boss today to get the pay rise delayed for a month... we've lived a long long time on the money we get so one more month isn't going to hurt!

    Really really pleased that we got the CAB financial advisor to step in when they wanted us to pay an IPA... we had filled the forms ourselves and missed off some vitals, so the financial advisor contacted the OR to say we'd been dumb and could they alter our figures... which they did... hence no IPA!
    At the time we didn't mind making payments but suspected that it would allow us to get on with rebuilding our life sooner!

    Thanks for your brilliant advice folks... I am now one happy girl!

    An IPA normally runs for up to 36 months from the day it is signed by the OR.
    They can be agreed or imposed (an IPO) in theory at any point in the 12 months of BR. However, in practical terms because of set-up time, this only normally happens within the first 10 months of BR.

    Legally an IPA/IPO must be agreed/ordered before discharge, so the OP is probably safe even if the pay rise goes ahead. It doesn't do any harm to be cautious through :)

    The money advisors at the CAB seem to a great source of help ,Iv not had personal experiance of them but i know Tight Jock used them and they were a great help .

    I think some of the problem people have with CAB is that they never get further than the old dear at point of contact. It is imperative that people speak to the Money Advice Unit as these are employed professional advisors who deal with nothing else.

    Ours was a saint.

    Unless you have been very naughty, or the OR cannot conclude their investigations within the 12 months, then discharge is always after 12 months or before.

    The IPA/IPO is a separate legal entity/agreement.

    This is my understanding anyway :)

    Initially I was told that the financial advisor at the CAB didn't meet or speak to the public and was only there to advise the normal advisors (if you see what I mean) but by my second visit, I'd confused everyone so much, he came down and chatted with me for 2 hours and then phoned me nearly every day until we were sorted out (took about a fortnight).
    He was absolutely brilliant! :T
