ebay seller says guarantee is invalid

I bought a shower screen from ebay shop last July with a 12 month warranty. It is now broken and ebay seller says that they only accept the invoice, which I can't find, as proof of purchase even although I have proof through paypal and ebay. Is this legal?

    Yes and no.
Yes, because a warranty is over and above your statutory rights so if the condition of the warranty states you need the invoice then so be it.

No, because your rights under SOGA would make this proof of purchase legal. The downside is that because you have had the item for over 6 months the burden falls to you to prove the item wasn't fit for purpose due to an inherent fault. To do this you would need a report to state it has failed due to a manufacturing fault through no fault of your own. This would need to be presented to the seller and if they still refuse a small claims court after that.

The seller is being awkward here and he knows it, a paypal receipt says exactly what it is so they simply don't want to show good cs,
  • My first question would be "how did it break?"

it is an over-bath screen and has to be swung out in order to get in. It started to make a noise when doing this and then the bottom hinge snapped. It turned out that the hinge was plastic painted to look like metal.
