Can I return a broken watch?

I bought my teen son a watch from Argos for xmas (sale date 10/12/12). He has dropped it and half the watch face has kind of smashed - the glass has cracks etc. I still have the receipt. Is there anything I can do? It cost £24.99 but I cannot afford to buy a new one. Does anyone know my rights?

PS: I have previously returned a camera that was dropped that wouldnt then focus and got a refund card as I had the receipt, even though it was bought just over 6 months ago.

    You have no rights, he dropped it!

    You could try taking it back to Argos but I doubt you will get anywhere, they could offer to repair it but may charge you.

  • Ok thank you for your reply. My son is careful - one cannot avoid 'accidents' like slips of the hands and such mishaps.

    Are you sure that I have no rights? That makes me curious as to why a camera that was dropped and subsequently did not work properly after purchasing six months ago was returned for a refund. A replacement was offered but it was no longer in stock.

    I might just take it back and see what I can do but I wanted to know where I stand in terms of the law as everything has a 12 month warranty.
  • A warranty is surely for faults not for accidental damage such as being dropped?

    I don't mean to sound rude but why should a company replace something that was dropped and broken? If you dropped and smashed a plate would you expect the company to replace that? Its the same sort of thing.

    ? Return because it's dropped, that does not come under faulty goods or part of the warranty (did you tell Argos you had dropped the camera when you took that back?).


    Don't you have home contents insurance that covers accidental damage?

    Did you tell them it was broken because you'd dropped it?
  • Yes I understand that but that leaves me confused as to why the camera was refunded as the same thing had happened.

    Then you were lucky either because the shop assistant didn't ask how it was broken, or your husband didn't admit it.

    The only scenario you'd have a case is if the product should have been durable enough to withstand being dropped. Most cameras and watches certainly wouldn't be, unless they were advertised as 'rugged'.
  • yes I guess we were lucky on that occasion.

    The watch was marketed as 'tough and ready for all activities' with scratch resistant glass.
