Car problem:(

Wondering if someone can help me here.

I purchased a Vauxhall Zafira on 9th Jan 2012. Car was brought from Aberdeen Arnold Clark to Dundee Branch.

Everything seemed fine. The date of warranty was empty before we signed so my dad asked what the warranty period is and the salesman said a year. However my dad asked the salesman to write the date on the warranty card then so we have proof which he did.

Problems started few days after having the car. Every 2 weeks the engine management light came on or some other kind of repair. Wasnt too worried at this point as had a years warranty. However after few months Arnold Clark refused to repair the car as really warranty is only for 2 months and not a year! I said we have it on the actual card in writing. They still refused.

Took the matter to Trading Standards and really all that happened was a waste of time. After numerous calls to the man that was dealing with this matter he said that this has been taken to the Procurator Fiscal for ciminal charges. Heard back from Fiscal saying he cant do anything and to take it through small claims court! Car cost me over £7000!!!

Luckily ( ithought) that i had made payment through credit card. Called the Card company (tesco) and it has been weeks and weeks and not getting any reply. Spoke to Financial Ombudsmen and now they say another 8 weeks for them to look into the case.

Am i going through this the right way? The car at the moment is not on road as it has ran out of MOT and to get one it will cost me £2000 worth of repair work.

    £2000 repair to pass an mot? What needs doing? This figure sounds highly unlikely, and banger can usually be made road worthy for a quarter of that.

    What are the faults with the car? And are they faults as in failed prematurely or faulty because of reasonable wear and tear?
    What does the warranty cover? More to the point does it cover the faults above?

    What outcome are you hoping for?

    If you feel they've breached the terms of the warranty you can put them on notice you will be having te repairs done elsewhere and recovering the cost from them... After a reasonable time has passed (say 14 days) have the repairs done and proceed to small claims court.

    What date did you report he original and subsequent problems? What was these problems or was it the same issue?

    Not necessarily, mine had £2,500 spent on it last week after the flywheel destroyed the clutch and gearbox. It was a case of working out if the car was worth more repaired or not, it was a close run thing but in the end we opted to repair.

    Interestingly the Zafira shares a common engine and gearbox with mine so if this is the 1.9 CDTi model its quite feasible that it needs this kind of money spending on it as it is notorious for failures.

    That's nothing to do with the mot though. If the car is undrivable because a major conponent had failed then that should be his focusing point, otherwise if te car is still running then the condition of the flywheel is irrelevant to passing an mot.

    If it's offroad because it needed the repairs and the MOT ran out while it was offroad then it's understandable to describe it as needing £2000 of repair work to get it through the MOT.
    I cant see how a car with a shot gearbox, clutch and flywheel would pass an MOT tbh because you certainly couldn't drive it to the test station.

    OP needs to clarify exactly what the issues are as this is all conjecture currently.

    I'm taking op to mean to get the car to a condition it would pass based on the mot check points rather than how much it would cost to get back on the road again, but ye I see your point.

    May worth op giving a more detailed description of the problems.

    Right the ABS light is ON most of the time.
    Engine management light also.

    No matter how many times i have taken car for repair doesnt seem to rectify the problem.

    If you don't know how to fix it how can you know how much it will cost to fix it?

    The ABS light is your only problem, the Engine Management Light is not an MOT failure.

    Because I took it in before Mot ran out and they said this is how much it will approx.

    So they know whats wrong then....have you presented this information in writing to the dealer concerned?

    AC have a reputation for being poor - a quick google shows the extent...

    Yes I have and they said they will not do anything. That's why I contacted Trading standards etc.
