amazon seller refund

Hi

Looking for a bit of advice. We decided in October to cancel sky and get a free sat box, we hasve used the box but it keeps failing to record or freezing and needs resetting. I have emailed the seller on amazon telling them this and they have said - " Dear customer, here at Amazon we offer a 30 day warranty, however we offer 90 days, but unfortuantly you are outside of this period too. Sorry for any inconvenience cause".

can I return under the sale of goods act? If I can how do I do that? Any advice would be greatly appreciated I'm not very good at things like this!

    If it was purchased from a business in the UK, then yes SoGA will apply.

    If a fault occurs within the first 6 months, the burden of proof is on the retailer to prove the item is not inherently faulty. After 6 months, it switches to the consumer. Once acceptance has occurred, you can request one remedy over another (repair, replace, refund - which can be partial to take into account use you have had of the item) but the retailer can refuse if disproportionately costly.

    Put your complaint in writing to them. If you google for SoGA template letter, you'll find loads of examples to give you an idea what to include :) Keep it simple and to the point, try not to include anything that doesnt need to be there.

    So I emailed the seller and he replied saying it wasn't up to him to give a refund and I needed to contact Amazon.

    So contacted amazon who said the seller needs to refund me the money to and I need to let the seller know this but get back to amazon if he doesn't reply within 3 days.

    3 days came and went and I wasn't surprised the seller never replied to my email, emailed amazon back to let them know he's not replied. They said I can open an a to z case, but when I log into my account it won't let me!

    amazon have now told me its not possible to open an a to z case as its past 3 months but this doesn't change my rights under the sale of goods act.

    Anyone any advice on where to go from here? I've a freesat box that doesn' work and I'm £145 out of pocket with hubby saying we should have stayed with sky!
