We were told in our Think 21/25 training not to sell alcohol to people that are clearly intoxicated. I'm not sure if it is the law or just a recommendation. There were some known drunks who were known to get violent when refused alcohol so we were told to serve them regardless.
This is where you went wrong - you should have got violent and would have been served

Unfortunately these days all these policies have been taken way to far. Seems there is a fine line between being responsible as a retailer and lacking in common sense. I saw a middle aged woman in co op once refused a bottle of wine despite looking her age and having a briefcase - she was a university professor.

If i had been in a pub i could understand if i was falling about the place but i was just buying a bottle of wine.

He has more than a right...he has a legal duty not to sell alcohol to someone he believes to be drunk. Selling alcohol to someone who is drunk is punishable by a fine of up to £1000.
You have the right to not try to buy alcohol while already drunk or (if you weren't drunk) think about your behaviour and why the sales assistant thought you were drunk (and hopefully amend your behaviour to prevent a similar thing from happening in future).Common sense?...There's nothing common about sense!0 -

Just because somebody has already had a drink doesn't make it irresponsible to sell them another.
Just go to a local shop next time op, rather than a chain - you will rarely will them refusing your custom0 -

Not automatically, but it would all come down to the view of the checkout assistant, which is subjective. For them, the risk of selling booze to someone who is drunk is greater than the reward of selling a bottle of wine, ergo they will tend to err on the side of caution if in doubt. I still get asked for ID from time to time, despite the fact I'm rapidly approaching 30.I wonder how pubs and clubs get away with it then... Hmm...
