I need to know my rights as a buyer before I send another complaint to the seller.
On the 7th December 2012 I brought two PC Tablets from whom I thought was a reputable Seller after looking at their excellent feedback, Also accepted returns. Communication had been excellent with the seller who knew they were to be christmas pressies and was very helpful. As the tablets were Christmas pressies for my sons they were not used until Christmas day. After only an hours usage there were problems, overheating and blown speaker. The seller was very helpful and offer replacements or refund, so I opted for the replacements. Replacements came, same problem occured, so this time I asked for the full refund which Seller refused (said it was only an offer of refund on first tablets) and offered up graded tablets. I tried to open a case on ebay but it wouldnt let me due to 45 day time limited and it was 47th day I tried to open a case. I then tried live chat with customer services who informed me to open a case and that I would be entitled to a refund as the seller states returns accepted and the tablets were not as described. After numberous live chats trying to explain I can not open a case due to the time limited, I was then told Sellers have rights to thats why theres 45 day time period.
After leaving me disappointed and confused I didnt want to loose money so yet again I contacted the seller who then informed me that I would receive totally different, more expensive,up graded tablets and I would be pleased. So yet again I accepted his offer.
I received the replacements yesterday and guess what.....same tablets not the more expensive, up graded as he promised.
I really want my money back now!
Can anyone offer me advice so I know were I stand before I contact Seller today.

It can lead to the members own account being identified.
Personally, one dodgey item would have been enough for me and i would have snapped their hands off for a refund. The reason they didn't offer it second time arround - is because they knew you time was up.
Small claims and a big fat negative feedback are the way forward.0 -

Unless I misunderstand the OP got two replacements and the PC he has got now works fine, so I can't really see what the problem is, and why he'd want his money back if in the end he got what he paid for.
He was offered a refund the first time but accepted a replacement instead, it seems to me that the seller behaved correctly, a part from the fact that he didn't send an upgrade (maybe there was a misunderstanding, he seemed to have been a good seller until then).
Small claims? I'd like to be there and look at their face when OP explains he got what he paid for.
And even a negative seems a bit harsh when the item was replaced twice, and the option of a full refund was given the first time.0 -

I thought OP still had a faulty item. When it said the same tablet came back - i thought it meant the faulty one.
Totally agree - not much can be done if items working - Op got what was paid for.
But OP was promised a better item - that should still be reflected in feedback.0
