Holiday entitlement

I have been working part time for four months covering whilst an employee is on long term sick and asked my employer whether I am accumulating any holidays but my employer said I am not entitled to any holidays as I am only a temporary worker. I was under the impression that you accumulated holidays for every month you worked. Would be grateful if anyone can confirm if I am legally entitled to holiday pay during my employment.

Are you working direct for the employer or through an agency? I would have thought that if you were working direct you were entitled to holiday pay from the employer, but if working through an agency then your holiday would accrue with them and they would pay you for your days off, not the employer.DMP Mutual Support Thread member 244

Whoever you are working for you are entitled to holiday pay for each hour worked let alone each month. The easiest way to work out your entitlement is to add up all your hours worked from the beginning and multiply by 12.07%, this will tell you how many hours you are owed.Be Alert..........Britain needs lerts.0

They're talking rubbish and hopefully someone can point you to the legislation that says so. What if the person ends up being off sick for a year?!DMP Mutual Support Thread member 244

Seriously? They told you this? You are entitled to holiday from the first day you start so statutory holiday for 5 days a week would be 28 days in 12 mths to include b/h so say you have worked say 4 weeks you are entitled to 28/52*4 which would be 2.15 daystinmachine wrote: »I am employed by the employer and not by an agency but my employer said I am not entitled to any holidays as I am only temporary Filling in whilst a member of staff is on long term sick. We’ve had to remove your signature. Sorry but your calculations are wrong, you have to divide the 28 days holiday by 46.4 not 52.Be Alert..........Britain needs lerts.0 -
OP, what hours do you work and how many days?Be Alert..........Britain needs lerts.0
